2.3. Покупець несе повну відповідальність за надання неправильної інформації, в результаті чого продавець не може належним чином виконати свої зобов'язання перед покупцем.

2.4. Ціни на товари встановлюються продавцем на власний розсуд і вказані на сторінці інтернет-магазину за адресою: iamyourfetish.com.ua

2.5. Ціна товарів вказана в доларах США.

2.6. Пропозиція укласти договір на конкретні товари є дійсною протягом наявності товарів на вебсайті продавця, за умови їх наявності на складі продавця.

2.7 Ціна товару може бути змінена продавцем в односторонньому порядку. Ціна на товари, замовлені покупцем, не може бути змінена.

2.8. Продавець має право надавати знижки на товари та запроваджувати бонусні програми. Види знижок, бонусів, порядок та умови їх нарахування визначаються в інтернеті та можуть бути змінені продавцем в односторонньому порядку.

2.9. Якщо покупець замовив товари без доставки, він може самостійно отримати замовлені ним товари за адресою продавця, розміщеною на сайті.

2.10. Приймання товарів здійснюється покупцем в момент їх доставки або отримання за адресою продавця. У разі оплати товарів готівкою, товари передаються покупцю після повної оплати.

 

3. Доставка замовлення.

3.1. Продавець опрацьовує та підтверджує замовлення протягом 1-5 робочих днів з моменту його замовлення. Якщо продавцю потрібен додатковий час для обробки та підтвердження замовлення, новий термін узгоджується з покупцем.

3.2. Дата доставки товарів може бути змінена в односторонньому порядку продавцем у разі виникнення об'єктивних причин, на думку продавця.

7. Способи оплати

8. Момент укладення договору

8.1. Текст цього договору є публічною офертою відповідно до ст. 633 і ст. 641 Цивільного кодексу України і є еквівалентом "усної угоди" та має відповідну юридичну силу.

8.2. Договір, укладений на підставі прийняття покупцем цієї оферти, є договором приєднання, до якого покупець приєднується без будь-яких вилучень/застережень.

8.3. Факт замовлення покупця є абсолютним фактом того, що покупець приймає умови цього договору. Покупець, який придбав товари в інтернет-магазині продавця (оформивши замовлення на товари), вважається особою, яка вступає у відносини з продавцем на умовах цього договору.

8.4. Продавець зобов'язується:

негайно після публікації та вважаються доведеними до відома покупця з моменту цієї публікації.

8.5.2. Без погодження з покупцем передати свої права та обов'язки щодо виконання договору третім особам.

8.6. Покупець зобов'язується:

8.6.1. Перед укладенням договору ознайомитися зі змістом та умовами договору, цінами на товари, які пропонуються продавцем в інтернет-магазині.

8.6.2. Для оформлення замовлення покупець повинен ввести свої дані та оформити замовлення виключно за допомогою консультанта покупця з доступних способів для покупців.

8.6.3. Для виконання зобов'язань продавця перед покупцем останній повинен повідомити всі необхідні дані, що ідентифікують його/її як покупця та достатні для доставки покупцю замовлених ним товарів.

8.6.4. Оплатити замовлені товари та їх доставку на умовах цього договору.

9. Відповідальність

9.2. Продавець не несе відповідальності за зміст і функціонування зовнішніх ресурсів.

9.3. Сторони несуть відповідальність за невиконання або неналежне виконання умов, передбачених цим договором та законодавством України.

9.4. У разі виникнення форс-мажорних обставин сторони звільняються від виконання умов цього договору. Під форс-мажорними обставинами розуміються події надзвичайного, невідворотного і непередбачуваного характеру, що перешкоджають або об'єктивно ускладнюють виконання цього договору, виникнення яких сторони не могли передбачити або запобігти розумними заходами.

9.5. Сторона, яка посилається на форс-мажорні обставини, повинна повідомити іншу сторону про їх виникнення та особливості.

 

10. Інші умови

10.1 Продавець може передати або іншим чином передати свої права та обов'язки, що виникають з його відносин з покупцем, третім особам.

10.2 Вебсайт і надані послуги можуть бути тимчасово недоступні частково або повністю через профілактичні чи інші роботи або з будь-яких інших технічних причин. Технічна служба продавця має право періодично проводити необхідні профілактичні або інші роботи з попередженням або без попередження покупців.
